Henry John Howard Tripp states: I am agent for the Elliken Bishi Company in Hongkong and I reside in No 61 Wyndham Street. The defendant is in charge of a religious ceremony which is being held in D'Alquilar Street and the adjoining lanes. The Religious Ceremony consists of a large mat house in D'Aquilar Street, and of smaller wattled buildings in the adjacent lanes. Incessant playing of music, beating of gongs, and other Chinese musical instruments went on in all these buildings. It commenced at 7 p.m. on the 24th August and lasted without intermission until 11.30 p.m., the effect being that the whole neighbourhood was disturbed. From 11 p.m. to 11.30 p.m., there was shouting, screaming and what sounded something like a riot. I live in the vicinity of D'Aquilar Street, and the noise was intolerable.

To question but defendant states: best to stop it at 10.30; but the I did my people in the street who have paid the subscription objected to its being stopped so soon.

Thomas Arnold sworn states: I am Secretary to the Hongkong, Canton and Macao Steamboat Company and reside in Wyndham Street. I can entirely corroborate what the last witness states. The noise was going on incessantly from 7.30 to 11.30 p.m. and it is an intolerable nuisance. The effect with regard to myself has been that it has given me such a headache as
